1. This competition is open to all persons aged 18 and over except the promoters employees or members of their immediate family, agents or any other person who is connected with the creation or administration of this competition.
2. By entering this competition the entrant will be deemed to have read and understood these rules and to be bound by them and by any other requirements set out in any related promotional material. The competition is governed by English Law and any matters relating to the competition will be resolved under English Law and the Courts of England shall have exclusive jurisdiction. In the event of playing this competition online, by accepting these terms and conditions you confirm that you are not breaching any laws in your country of residence regarding the legality of entering our competitions. The Promoter will not be held responsible for any entrant entering any of our competitions unlawfully. If in any doubt you should immediately leave the website and check with the relevant authorities in your country.
3. (a) To enter the competition online please select the answer to the question by selecting either the option A, B or C along with your entry. When entering by SMS please text the relevant keyword i.e "WINFTKT" followed by your answer, A, B or C to the five digit shortcode, i.e "88999". The organiser accepts no responsibility for incorrect entries, and only those bearing the correct answer will be entered into the draw. The first correct entry drawn on the completion of allocated ticket sales for each relevant game will be the competition winner.
(b) If the competition can be played online,(may vary depending on prize available) follow the on-screen instructions and play the competition as outlined in (a). When you are ready to purchase your ticket(s), follow the on-screen instructions to provide your contact details and then your credit card / paypal details. When your credit card / paypal payment is cleared we will then contact you by email to confirm your entry into the competition.
5 . The winner will be selected at random by an independent person in the presence of a Text-Fest representative. The winner will be selected using our advanced number selection software. All decisions of the judge will be final and binding on the competitors and no correspondence will be entered into. All competitors are automatically entered onto Text-Fest's database for the purpose of conveying information as to the status of their competition, as well as for any future promotions, competitions or deals offered by Text-Fest.
6 The winner will be notified at the address or telephone number given in the contact details within 21 days of the closing date of the relevant competition. Any entrant may check the results of previous competitions via the website when the details have been posted.
7 The winner will be required to send a copy of their passport to the Promoter to confirm their identity, age and also to prove that if the purchase was made by credit card that the card was legally theirs or they had authorisation to use it, before any prize will be paid or delivered. Following receipt and verification of the details above by the Promoter, the winner will be contacted in order to make arrangements for the delivery of the prize.
8 All prizes are subject to availability from UK suppliers. We aim to give the advrtised prize for each competition wherever possible, but do reserve the right to offer an alternative should the advertised prize become unavailable. Any alternative prize will be reflective of the type and value of the advertised prize.
9 There is no cash alternative to any of the prizes listed on this site.
10 Acceptance of the prize by the winner gives the Promoter the sole right to use the prize-winners name, personal photograph and home county for promotional purposes, both immediately after their win and in the future, unless prohibited by law.
11 The Promoter reserves the right to cancel any competition, for any reason, before all tickets are sold. In these circumstances the Promoter reserves the right to transfer the customers ticket into another competition for which the ticket price is at least the same or more than the original price paid.
12 The Promoter makes no representations or warranties as to the quality/suitability of any of the goods or services offered as prizes. Except for liability for death or personal injury caused by the negligence of the Promoter, the Promoter shall not be liable for any loss suffered or sustained to person or property including, but not limited to, consequential (including economic) loss by reason of any act or omission by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods by any person to the prize-winner and, where applicable, to any family/persons accompanying the winner, or in connection with any of the competitions promoted by the Promoter. If the prize is a vehicle, relevant insurance of at least third party UK road insurance will be required to be arranged by the competition winner if it is so required. Insurance is not provided or part of the prize on any game and is the sole responsibility of the winner.
13 No responsibility will be accepted for failed, partial or garbled computer transmissions, for any computer, telephone, cable, network, electronic or internet hardware or software malfunctions, failures, connections, availability, for the acts or omissions of any service provider, internet, accessibility or availability or for traffic congestion or unauthorised human act.
14 Data Protection Notice: Any personal data that you supply to the Promoter or authorise the Promoter to obtain from a third party, for example, a credit card company, will be used by the Promoter (i) to administer the competition; and (ii) (unless you tell us that you prefer not to receive direct marketing) to contact you about other competitions or about other goods and services which the Promoter considers may be of interest to you.
In order to process, record and use your personal data the Promoter may disclose it to (i) any credit card company whose name you give; (ii) any organisation (whether or not connected to the Promoter) for the purpose of bringing to your attention goods and services which the Promoter considers may be of interest to you; (iii) any person to whom the Promoter proposes to transfer any of the Promoter's rights and/or responsibilities under any agreement the Promoter may have with you; (iv) any person to whom the Promoter proposes to transfer its business or any part of it; (v) comply with any legal or regulatory requirement of the Promoter in any country; and (vi) prevent, detect or prosecute fraud and other crime.
In order to process, use, record and disclose your personal data the Promoter may need to transfer such information outside the United Kingdom, in which event the Promoter is responsible for ensuring that your personal data continues to be adequately protected during the course of such transfer.
The competition will be closed on the sale of the ticket allocation for each individual game. The ticket allocation will be set by the promoter dependant on the value of the prize available. Players may enter as many times as they wish, subject to there being sufficient ticket allocation remaining in that particular game. Online entries will be charged at £1.00 per online entry if available or £1.00 per sms entry (GBP). A new game will commence immediately at the close of each competition. The winners details of the previous game may be posted to the website by use of personal details and photographs as selected by the promoter.
There will be no refunds on competition entries under any circumstances. If the competition can be entered online all entrants must enter the competition by using credit card / debit card or paypal details to which they are permitted to use by law. |
